Terms of Service

Welcome to iVnchr ("we," "us," or "our"). These Terms of Service, together with the End User License Agreement provisions in Section 13, constitute the binding agreement ("Terms" or "EULA") between you and iVnchr governing your use of the iVnchr website located at ivnchr.com, the iVnchr mobile applications (iOS and Android), and all related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, you must stop using the Service immediately.

1. Eligibility

You must be at least 13 years old to use iVnchr.

Our Adventure Connect feature allows you to meet other outdoor enthusiasts in person. You must be 18 or older to create or join adventures. Minors may attend adventures in person when accompanied by a parent or guardian.

2. Your Account

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your login credentials
• Be responsible for all activity that occurs under your account

3. User Content

"User Content" includes videos, comments, photos, and any material you upload, post, or display through the Service.

Ownership

You retain ownership of your User Content. By posting User Content, you grant iVnchr a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, distribute, and process your content solely for the purpose of operating and improving the Service.

Responsibility

You are solely responsible for the User Content you post and represent that you have all necessary rights to do so.

4. Copyright (DMCA)

We respect the intellectual property rights of others. If you believe content on iVnchr infringes your copyright, please send a notice to [email protected] with "DMCA" in the subject line. We will review and respond in accordance with applicable law.

In appropriate circumstances, and at our discretion, we may suspend or terminate accounts of users who are repeat copyright infringers.

5. Community Guidelines and Zero Tolerance for Objectionable Content

Your use of the Service is subject to our Community Guidelines.

The following are strictly prohibited and will result in immediate content removal and permanent account termination:

• Sexually explicit, pornographic, or graphically violent content
• Hate speech, harassment, threats, or bullying targeting any person or group
• Content that promotes self-harm, suicide, or eating disorders
• Content that endangers, exploits, or sexualizes minors
• Content that incites or glorifies illegal or dangerous acts
• Spam, scams, fraud, or impersonation of another person
• Content that violates the privacy or intellectual property rights of others
• Any other content or conduct that we, in our sole discretion, determine to be objectionable or abusive

Reporting Objectionable Content and Abusive Users

Every video, comment, message, and Adventure Meetup post in iVnchr can be reported using the in-app flag mechanism. Users can also block any other user directly from a video, comment, or message that user has posted. When you block a user, that user's content is removed from your feed instantly. Video creators can also report or delete comments under their own videos, and block specific users from commenting on individual videos.

Our Response Commitment

iVnchr commits to reviewing all reports of objectionable content or abusive behavior within 24 hours and taking appropriate action, which may include removal of the content and ejection (permanent termination) of the user who provided the offending content.

6. Prohibited Activities

You must not:

• Violate any applicable law or regulation
• Attempt to gain unauthorized access to the Service or its systems
• Use bots, scrapers, or automated means to access the Service
• Upload malware, malicious code, or harmful content
• Impersonate another person or misrepresent your affiliation

Your privacy is important to us. Please review our Privacy Policy at our Privacy Page.

8. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, pose a legal risk, or misuse the Service. You may stop using the Service and delete your account at any time.

To the fullest extent permitted by law, iVnchr will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or reputation, arising out of or related to your use of the Service.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date.

13. End User License Agreement (EULA) — iOS App Store Provisions

The following additional terms apply to your use of the iVnchr iOS application obtained from Apple's App Store. These provisions are included to satisfy Apple's End User License Agreement requirements and form part of the binding agreement between you and iVnchr.

13.1 Acknowledgement

You acknowledge that these Terms are concluded between you and iVnchr only, and not with Apple Inc. ("Apple"). iVnchr, not Apple, is solely responsible for the iVnchr iOS application and the content thereof.

13.2 Scope of License

The license granted to you for the iVnchr iOS application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

13.3 Maintenance and Support

iVnchr is solely responsible for providing any maintenance and support services with respect to the iVnchr iOS application, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

13.4 Warranty

iVnchr is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iVnchr iOS application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be iVnchr's sole responsibility.

13.5 Product Claims

iVnchr, not Apple, is responsible for addressing any claims you or any third party may have relating to the iVnchr iOS application or your possession and/or use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

13.6 Intellectual Property Rights

In the event of any third-party claim that the iVnchr iOS application or your possession and use of the application infringes that third party's intellectual property rights, iVnchr, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

13.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13.9 Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the iVnchr iOS application.

13.10 Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms with respect to the iVnchr iOS application, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
